Liability Waiver
CONSENT FORM, WAIVER, AND RELEASE AGREEMENT
I, the undersigned, hereby agree to the following:
MEMBERSHIP FEE: Your membership fee entitles you to all the rights and privileges of membership at the Gym. You agree that by signing this contract (or clicking Yes), you are required to pay for all membership dues and account charges whether or not you utilize the services of the Gym.
BILLING: All accounts with a balance due for membership or account charges will be processed/drafted monthly. The Gym reserves the right to increase membership dues at any time.
Current Membership pricing: These prices are subject to change at any given time. Please verify the correct package is selected in your shopping cart.
Basic Fit $29.99 - Includes access to fitness equipment and saunas.
Performance $34.99 - Includes the Basic Fit + access to the Tanning beds & Massage Beds.
Payment Schedule: The first payment will commence today and expire on this same date of the following month. Future payments will automatically charge your account monthly on this same date every month until cancellation of this account.
PREAUTHORIZATION: If this pre authorization payment agreement is revoked for any reason, this does not release you from your obligation (Payment Schedule). The Privilege of making payments under this arrangement may be revoked by the company if any item is not paid upon presentation.
AUTOMATIC OPEN RENEWAL POLICY: Your scheduled payments will continue in accordance with the current membership rate. Please be advised that scheduled dues payments in the open renewal period will continue month to month indefinitely until you apply for cancellation.
YOU, THE CONSUMER, MAY CANCEL THIS AGREEMENT AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE ON WHICH THE CONTRACT IS EXECUTED.
All cancellations must be completed on our website, by email, or by mail 72 hours before your next billing date.
LATE FEE: If your account is past due 5 days, a one-time late fee of $15.00 will be charged to your account.
EXPRESS WRITTEN CONSENT TO RECEIVE MARKETING: By signing this agreement, you authorize the gym and/or its service providers to contact you by phone call, text message, or email.
PHYSICAL CONDITION: You understand that fitness activities involve physical exertion and you acknowledge the risks involved.
ASSUMPTION OF RISK: You voluntarily assume all risks related to participation in fitness activities, tanning, massage, or other services provided by the facility.
HOLD HARMLESS: You agree to hold harmless and defend the Gym from any claims related to injuries, illness, damages, or loss associated with use of the facility.
VIOLATIONS OF RULES: The Gym may revoke membership privileges at any time for rule violations.
NOTICE TO CUSTOMER: You are entitled to a copy of this contract at the time you sign it.
AT-WILL TERMINATION: The Gym reserves the right to cancel this contract and/or revoke member privileges at any time.
TANNING (UV SYSTEM) HISTORY & CONSENT:
Overexposure to ultraviolet radiation may cause burns, premature aging of the skin, or skin cancer. Eye protection is required. Persons under 18 must have parent or guardian consent.
I have read and fully understand this Acknowledgement and Release of Liability set forth above, including the release of all claims, including claims for negligence.

Choosing a key card instead of facial recognition requires a one-time $80 fee. Key fobs must be picked up during staffed hours at the front desk.
